OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. Subject to federal, state, and local laws, regulations, and ordinances. Void in Puerto Rico, the U.S. Virgin Islands, U.S. Military Installations located in foreign countries, and where prohibited by law. The Homes.com 2024 Baseball Promotion (the “Promotion”) will commence at 12 P.M. Eastern Standard Time on April 2, 2024 and end at 11:59:59 P.M. Eastern Standard Time on April 30, 2024 (the “Promotion Period”). The Sponsor of this Promotion is CoStar Realty Information, Inc. (“CoStar” or “Sponsor”), 1331 L Street, NW, Washington, DC 20005. Participation constitutes entrant’s full and unconditional agreement to these Official Rules, which are final and binding in all matters related to the Promotion.

THIS PROMOTION IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH ANY SOCIAL MEDIA PLATFORM INCLUDING WITHOUT LIMITATION TWITTER, TIKTOK, PINTEREST, LINKEDIN, OR FACEBOOK OR INSTAGRAM FROM META (“SOCIAL MEDIA PLATFORM(S)”).

ELIGIBILITY: This Promotion is a trade promotion that is open only to licensed real estate agents who are existing subscribers to the Homes.com platform (“Platform”) as of the start of the Promotion Period. The Promotion is open to legal U.S. residents currently residing in the 50 United States and the District of Columbia who are eighteen (18) years of age or older as of the date of entry (“Participants”). Employees, officers, and directors of Sponsor or Sponsor’s parents, affiliates, subsidiaries, representatives, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, and members of their immediate families (spouses, parents, siblings and children, regardless of where they live) and those living in the same household are not eligible to enter or win. Employees, officers and directors of competitors of Sponsor or Sponsor’s affiliates are not eligible to enter or win. Sponsor reserves the right to verify the eligibility of winners.

HOW TO ENTER: Participants will receive an email inviting them to enter. To enter, Participants must submit a video or written testimonial sharing how Homes.com has helped their business to testimonials@homes.com (an “Entry”). Videos must be at least 30 seconds in length and written testimonials must be at least 2-3 sentences. Entries must be in English. Each Participant may submit only one (1) entry into the Promotion. Additional entries will not be counted and Participants who submit more than one (1) entry into the Promotion may be disqualified at Sponsor’s sole discretion. The potential winner is subject to verification before any prize is awarded and may be required to show proof of meeting all eligibility requirements. Sponsor is not liable for lost, late, misdirected, or corrupted Entries whether due to a technical error or otherwise. Entries become the property of Sponsor and will not be acknowledged or returned. Sponsor shall have the sole discretion to determine the validity of an Entry. Automated or bulk Entries or Entries submitted by third parties will be disqualified. Incomplete, illegible, corrupted or untimely Entries are void and will be disqualified.

As determined in Sponsor’s final sole and absolute discretion, Entries containing the following will be void and ineligible for entry:

Entries that are obscene, discriminatory, offensive, contain profanities, or endorse any form of hate or hate group;

Entries that depict dangerous activities, irresponsible behavior, or use of Sponsor’s products or services in a manner contrary to their intended use;

Entries that defame, misrepresent, violate the privacy, publicity and/or other intellectual property rights of Sponsor or third parties; and

Entries containing any language or images communicating messages inconsistent with the image with which Sponsor wishes to associate.

WINNER SELECTION: Promptly following the conclusion of the Promotion Period, Sponsor will select its favorite ten (10) Entries out of all submitted Entries to be potential winners. All Winners receive the Prize described below. The odds of winning depend on the number of eligible Entries received during the Promotion Period.

Prior to being confirmed as a Winner, the potential winner(s) will be required to sign and return an Affidavit or Declaration of Eligibility and Liability/Publicity Release within two (2) days of notification. If the potential winner(s) fails to respond within two (2) days of notification, fails to return a winner’s release/affidavit, or is disqualified for any reason, Sponsor retains discretion to award the Prize to an alternate winner selected from all remaining eligible Entries, time permitting. Upon Prize forfeiture, no compensation will be given. The potential winner must continue to comply with these Official Rules and winning is contingent upon fulfilling all requirements.

PRIZE: Winners will have their Entries featured on Sponsor’s social media platforms and each will receive six (6) lower-level of club-level tickets and three (3) parking passes, at Sponsor’s sole discretion, to a professional baseball game of Winner’s choice during the 2024 baseball season. Each ticket will be valued at $100 or less. Each parking pass will be valued at $50 or less. Total Prize ARV: $7,500. Tickets are to regular season games only. Winners will receive the tickets and parking passes via email. By accepting any Prize, Winner grants permission to Sponsor to use winner’s name, voice, likeness, Entry submission and statements for publicity purposes without further compensation, consideration or consent, except where prohibited by law. Winner represents and warrants that it has obtained or will obtain all necessary and appropriate permissions to allow Sponsor and its representatives to provide it with the Prize. The Prize is not negotiable with the Winner. The Prize is non-transferable, and no substitutions are allowed except by Sponsor who may substitute a prize for one of equal or greater value for any reason. Winner is solely responsible for all applicable federal, state and local taxes and fees, including income or local personal property taxes, insurance, licensing, registration and title fees arising out of the receipt and use of the Prize. Any difference between the stated estimated value of a prize and its actual value will not be awarded.

SPONSOR’S RIGHTS. Participation in Promotion constitutes Participant’s grant to Sponsor and its partners and designees, the irrevocable and perpetual nonexclusive right to use, publicly display, print, publish, reproduce, distribute, modify, create derivative works from, and provide access to each Participant’s Entry submission, name, address (city and state/province/territory), likeness, photograph, picture, portrait, voice, opinions, biographical information and/or any statements made by Participant’s regarding the Promotion or the Prize(s) for advertising and promotional purposes without limitation, in any media, worldwide, without notice or additional compensation or consent, except where prohibited by law. If a Participant chooses to submit or post any media content (including to but not limited to photographs, videos, recordings) in connection with this Promotion, that Participant grants to Sponsor, its partners and designees, a worldwide, royalty-free, perpetual, non-exclusive right and license to use, reproduce, copy, distribute, and display each submitted Entry and any part thereof, in any media, and the right to use, copy, modify, edit, and create derivative works therefrom, and agrees to execute documents confirming such right and license at Sponsor’s reasonable request. By entering, you understand that your Entry will be reviewed by Sponsor and may be posted online to a gallery or featured in Sponsor’s social media channels or other advertising, in Sponsor’s sole discretion, to be viewed by members of the general public. By entering, each Participant warrants and represents that his/her Entry is original, has not been previously published or won any award, does not contain any material that would defame or otherwise violate or infringe upon the rights of any third party, including patents, copyrights, trademarks or rights of privacy or publicity, and will not violate any federal, state or local laws or ordinances.

GENERAL CONDITIONS. This Promotion is governed by the laws of the United States. IF, FOR ANY REASON, THE PROMOTION IS NOT CAPABLE OF RUNNING AS PLANNED, SPONSOR RESERVES THE RIGHT AT ITS SOLE DISCRETION TO CANCEL, TERMINATE, MODIFY OR SUSPEND THE PROMOTION AT ANY TIME WITHOUT NOTICE OR OBLIGATION. SPONSOR SHALL NOT BE RESPONSIBLE FOR ANY INCORRECT OR INACCURATE INFORMATION, INCLUDING, WITHOUT LIMITATION, ANY TECHNICAL OR HUMAN ERROR WHICH MAY OCCUR IN THE PROCESSING OF SUBMISSIONS IN THE PROMOTION. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be attempting to tamper with or undermining the entry process or the legitimate operation of the Promotion or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person. By participating in the Promotion, all Participants agree that the state and federal courts located in the District of Columbia shall have exclusive jurisdiction over claims arising out of the Promotion and matters related thereto, and that all Participants agree to the venue and jurisdiction of such District of Columbia courts.

RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Promotion, Participants agree to release and hold harmless Sponsor, all Social Media Platforms, their subsidiaries and affiliates, and all of their officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Promotion or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Promotion; (b) errors on Sponsor’s website; (c) lost, delayed, postage-due, misdirected, or undeliverable communications; or (d) errors in the administration of the Promotion or the processing of entries. Participants agree that Sponsor, its parents, affiliates, subsidiaries, retailers, distributors, advertising and promotion agencies, suppliers, and those acting pursuant to its authority shall have no liability whatsoever for, and will be held harmless by Participants, against any liability for any injuries, losses, or damages of any kind to Participants or any other person or entity, including personal injury or death to winner or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize, entry, or participation in this promotion or in any promotion-related activity, or any claims based on publicity rights, defamation, or invasion of privacy or merchandise delivery. Participant further agrees that, to the extent permitted by law, in any cause of action, Sponsors’ liability will be limited to the cost of entering and participating in the Promotion, if any, and in no event shall the Sponsor be liable for attorney's fees. Without limiting the foregoing, everything regarding this Promotion, including the web site and any prize, is provided “as is” without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

PRIVACY: Information collected from Participants is subject to Sponsor’s Privacy Policy which can be found at https://www.homes.com/about/policies/. By entering this Promotion, you agree to the use of your personal information as described in the above Privacy Policy.
